These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
By registering and using our site you agree to the terms and conditions as set out herein. If you do not agree, you may not use or access our service.
In the event of any significant changes in the terms and conditions we will send notification emails to all active users and Voiceolution.co.uk reserves the right to change or update these terms and conditions from time to time. We suggest you visit these pages frequently as you are responsible for acknowledging any updates of these terms and conditions.
Definitions
"Company", "Voiceolution.co.uk" “VOICEOLUTION.CO.UK ” ("us", "we", "our" and "ours") means the operator(s) of this site.
"Customers", “Voice Seeker(s)” or “Clients” means any person who submits or publishes a requirement for services on the Website for an “Artist” to supply.
“Artist(s)”, “Talent”or “Voiceover Artist” means anyone seeking work through the site.
"Website" means the website Voiceolution.co.uk.com and all the pages and content contained therein.
“User(s)” means any registered person of the Website.
Overview of the Website
Voiceolution.co.uk (VOICEOLUTION.CO.UK ) is a website dedicated to introducing voice seekers to established voice over artists, providing a fast turnaround and delivering projects within budget targets.
Registration is free for both parties and you must register to use the site. Both Clients who are seeking services and Artists who apply to provide services must work within the mechanics and parameters of the site as we have set out. We will closely monitor activities and any messages.
All users must agree to not disclose personal contact details, address, e-mail or telephone numbers with an aim to avoid using the site for booking or enquiries. This is against the ideal of the site and we will monitor any contacts made via the site.
We reserve the right to remove any users who do not comply within the website terms.
Liability of Provided Voice Content
Client(s) are responsible for checking any copy or scripts for mistakes and legal issues prior to submission to Voiceolution and Voiceolution accept no liability for these issues.
Client(s) will choose a voice from our carefully selected voiceover artists. We choose our talent carefully based on their profile and on their availability to return projects promptly. If your chosen talent is not available within the timeframe required we will offer you an alternative talent that we feel suitable. This would be an extremely rare occurrence and you are not obliged to accept the alternative we suggest.
In the very unlikely event that any content or script(s) recorded by any voiceover Artist from our talent pool is unusable due to error on their behalf please contact us immediately for a resolution. We are very particular in choosing the talent for our site and expect complete professionalism from them at all times. This includes the quality of the recording and file delivery. We will make every effort in the first instance to have your project re recorded without further charges. If for any reason we cannot resolve your issue we are responsible only for the costs incurred that were imposed by our site. We do not accept liability for any other loss or losses incurred.
Voice and Content License
All licences for voices, music and/or any other content purchased from Voiceolution are for a period of one calendar year for the project, station or territory detailed in the initial order. We reserve the right to make further charges at any time should we find this period has been exceeded, or the content or any element of it, are found to be used in any way that contravene the license period.
Any audio recorded for clients will be kept secure by us for a period of 30 days.
Payment Terms for Clients
As a client seeking a voice for projects, payment is accepted via Paypal to ensure a fast efficient service. This means we may require your Paypal details upon registration to the site.
Frequent users (clients) can request a 30 day account by
contacting us directly. We consider all applications on an individual basis.
We may also consider setting up accounts on a Credits system whereby credits can be purchased in advance and then will automatically be deducted for each purchase. We will provide further details of this should we pursue this method.
We will notify you when the voiceover artist has completed your script and is ready for delivery.
Payment Terms for Voiceover Artists
We aim to pay Artist(s) providing voice content for clients within 30 days of the settlement of the client payment. We will pay this via our Paypal account. Therefore we will require your Paypal details upon registration.
Content Warranties & Liabilities
You agree that all material posted not limited to but including, messages, text, files, images, photos, video, sounds, or any other content posted on, transmitted through, or linked from Voiceolution.co.uk, are the sole responsibility of the person or user from whom such content originated. Each user is entirely responsible for all content that they post, email or otherwise make available through the website.
You understand that Voiceolution.co.uk shall not be liable for any loss, injury or damage of whatever kind caused in whole or in part by use of the Website or the information provided therein, or by any failure, delay, interruption or as a result of the use of any content posted, emailed or otherwise made available via Voiceolution.co.uk, or by Voiceolution.co.uk's failure to perform any of its obligations under these Terms.
Any links to content from other companies and websites are completely independent of Voiceolution.co.uk .Linking to any other websites through our site is done so entirely at your own risk. Under no circumstances will Voiceolution.co.uk be liable in any way for any content or for any loss or damage of any kind incurred. Voiceolution.co.uk makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such website.
You acknowledge that Voiceolution.co.uk does not initially approve all content, but that Voiceolution.co.uk reserves the right (but not the obligation) in its sole discretion to refuse, delete or remove any content that is available on the website if found to be against the agreed terms and the ideal of the website or for any other reason for which we do not have to give reason.
You acknowledge that Voiceolution.co.uk reserves the right to modify or discontinue the website (or any part thereof) with or without notice at any time. Voiceolution.co.uk shall not be liable to you or to any third party for any modification, suspension or discontinuance of any services. You also acknowledge that Voiceolution.co.uk may establish limits regarding use of the Website, in any scenario which is necessary. Examples are; the frequency of access, the maximum number of days that content will be retained by the website, the maximum number and size of postings, email messages, or other content that can be transmitted or stored by the Website. The possibility of limitation is not limited to the aforementioned scenarios.
You agree that Voiceolution.co.uk has no responsibility or liability for the failure to store any content maintained or transmitted by the Website it’s deletion. You agree that we shall not be liable for any loss or damages arising from the provision (or non-provision) of any part of the service, including loss of profit or consequential loss or damage.
By using the website you agree that Voiceolution.co.uk shall not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings with other users or third parties. If a dispute arises between Users and/or third parties, you understand and agree that Voiceolution.co.uk has no obligation to become involved and you hereby release Voiceolution.co.uk, its agents, officers, employees and/or any related associates from any demands, any claims and any damages whether actual and consequential.
Your dealings with other users or third parties found on or through the Website, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations and/or individuals.
Intellectual Property
Other than in relation to links to third party websites, Voiceolution.co.uk owns all the intellectual property rights relating to the site, including the designs, text, database, graphics and layouts. You are expressly prohibited from reproducing, copying, editing, transmitting, uploading or incorporating into any other materials of the Website; and removing, modifying, altering or using any registered or unregistered marks/logos owned by Voiceolution.co.uk and/or any companies promoted within, and from doing anything which may be seen as taking unfair advantage of the reputation and goodwill of the Website or could be considered an infringement of any of the intellectual property rights owned and/or licensed to the Website.
Listings, messages, text, files, images, photos, video, sounds, or other materials ("content") Users upload to the website which have intellectual rights are added to the site by Users at their own risk. In doing so you are giving expressed and irrevocable permission for us to store, display and use the content.
Data Protection, Privacy Policy and Technical data
Voiceolution.co.uk is committed to protecting the privacy of Users; and the confidentiality of the information provided to it by Users using the Website. However the Website is not in control of how third parties may use your information if you should separately register with them. Voiceolution.co.uk reserves the right to gather information relating to use of the Website. By using the Website you consent to collection and use of this information in accordance with our Data Protection and Privacy Policy.
